These Terms of Service ("Terms") form a binding legal agreement between you ("you", "user") and BrightMinds Learning, Inc. ("BrightMinds", "we", "us"). They govern your access to and use of the BrightMinds website, apps, and services (the "Service").
If you are creating an account on behalf of a child, you represent that you are the child's parent or legal guardian and that you accept these Terms on their behalf.
💡Quick summary: Use BrightMinds fairly, keep your account secure, and don't misuse the platform. In return, we'll deliver a great learning experience and protect your family's data.
If you do not agree to these Terms, please do not access or use the Service. We reserve the right to update these Terms at any time — see the "Policy Changes" section for how we notify you.
👤 Accounts & Eligibility
Who can use BrightMinds
👨👩👧Parents & GuardiansMust be 18 or older. Responsible for all activity under child profiles linked to their account.
🍎EducatorsTeachers and school staff aged 18+ using the Educator account type.
🧒ChildrenChild accounts are managed by a parent/guardian. Children under 13 cannot register independently.
Account responsibilities
🔐 Keep your password confidential and unique to BrightMinds
🔔 Notify us immediately at support@brightminds.app if you suspect unauthorised access
👤 You are responsible for all actions taken under your account
📧 Provide accurate, current information when registering
🚫 You may not transfer your account to another person without our written consent
💳 Subscriptions & Billing
How payments and refunds work
💰PricingCurrent prices are listed on our Pricing page. Prices exclude local taxes where applicable.
🔄Auto-renewalSubscriptions renew automatically. You will receive a reminder email 7 days before renewal.
❌CancellationCancel any time from Account Settings. Access continues to the end of the billing period.
💸Refunds7-day full refund for new subscribers. Thereafter refunds are discretionary. Contact support.
🏫School plansAnnual invoicing. Cancellations with <30 days notice may incur a 10% early-termination fee.
🎁Gift & promoGift codes and promotional discounts cannot be combined and have no cash value.
⚠️Payment processing is handled by Stripe. BrightMinds does not store card numbers. All transactions are secured by TLS 1.3 encryption.

🚫 You cannot
Copy, scrape, or republish BrightMinds content without permission
Use automated bots, scrapers, or mass-access tools
Attempt to bypass security, paywall, or parental controls
Post content that is harmful, offensive or illegal
Share login credentials between multiple households
Use the platform for commercial tutoring without a commercial licence
We may remove any content that violates these Terms and may suspend or terminate accounts for repeated violations.

Who owns what
🏢 All BrightMinds content — stories, videos, quizzes, AI models, branding and code — is owned by BrightMinds Learning, Inc. and protected by copyright law.
📝 Content you create (stories, quiz submissions, community posts) remains yours. You grant us a non-exclusive licence to display and store it for the purpose of delivering the Service.
🤖 AI-generated content produced using our tools is yours to use non-commercially. We retain the right to use anonymised outputs to improve our models.
🔗 Trademarks: "BrightMinds", the BrightMinds logo, "Buddy AI" and related marks are trademarks of BrightMinds Learning, Inc. Do not use them without written permission.
📩 Feedback: ideas, suggestions, and bug reports you submit may be used by us without any obligation to compensate you.
🤖 AI Features
How Buddy AI and our AI tools work
🛡️Safe-by-design. Buddy AI is built on models configured with strict child-safety filters. Outputs are filtered for age-appropriate content before being shown to any user.
📚 AI tutoring features are for educational assistance only — not a substitute for professional academic advice
🔍 AI outputs may occasionally be inaccurate. We recommend verifying important information independently
🚫 You may not attempt to "jailbreak", manipulate, or circumvent AI safety filters
👤 Conversations with Buddy AI are reviewed for safety by our moderation team
📊 Anonymised AI interaction data is used to improve model accuracy and child-safety filters
🌍 AI-generated stories and content are provided "as is" for personal educational use only

What we don't guarantee
⚠️The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
📶 We do not guarantee uninterrupted or error-free access to the Service
🎓 Educational outcomes vary and we do not guarantee specific academic results
🔗 Third-party links or integrations are not endorsed or warranted by us
📱 We reserve the right to add, modify, or remove features at any time
🌍 The Service may not be available in all regions or jurisdictions
🛡️ Limitation of Liability
Our maximum responsibility to you
To the maximum extent permitted by applicable law, BrightMinds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid to BrightMinds in the 12 months preceding the claim; or (b) £100 GBP.
💡Some jurisdictions do not allow certain liability limitations. In those places, our liability is limited to the minimum extent permitted by law.
🚪 Termination
Ending your relationship with BrightMinds
👤 By You
Cancel your subscription at any time in Account Settings. You can also request full account deletion by emailing privacy@brightminds.app. We will delete your data within 30 days (except where retention is legally required).
🏢 By BrightMinds
We may suspend or terminate your account for material breach of these Terms, fraudulent activity, or non-payment. We will give reasonable notice except where immediate action is necessary for safety or legal reasons.
⚖️ Governing Law
How disputes are resolved
🇬🇧 These Terms are governed by the laws of England and Wales
🤝 We will always try to resolve disputes informally first — email legal@brightminds.app
⚖️ If informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales
🌍 EU/EEA users: you may also use the EU Online Dispute Resolution platform (ec.europa.eu/odr)
📜 If any provision of these Terms is found unenforceable, the remainder will continue in full effect
